Acceptance of These Terms
These Terms of Service ("Terms") form a binding agreement between you and Living Plus Rx LLC, a Wyoming limited liability company ("Living Plus," "we," "us," or "our"), governing your access to and use of livingplusrx.com, any related subdomains, mobile experiences, and the services made available through them (collectively, the "Platform").
By creating an account, submitting an intake form, purchasing a membership, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Telehealth Consent, Notice of Privacy Practices, Platform Disclosure, and Medical Disclaimer, each of which is incorporated here by reference. If you do not agree, do not use the Platform.
Our refund and cancellation terms are set out in full in Section 12 of this document.
Section 23 contains a binding arbitration provision and a class action waiver that affect your legal rights, including your right to file a lawsuit in court and to have a jury trial. It also describes how to opt out within 30 days.
What Living Plus Is — and What It Is Not
Living Plus is a technology and administrative services company. Living Plus is not a medical practice, a pharmacy, a laboratory, or an insurer, and Living Plus does not practice medicine, dispense medication, or provide medical advice.
The Platform connects you with:
- Licensed healthcare providers practicing through OpenLoop Healthcare Partners, PC (the "Practice"), an independent professional entity. Providers exercise their own independent clinical judgment and are not employed or supervised by Living Plus.
- Licensed pharmacies, including state-licensed 503A compounding pharmacies and FDA-registered 503B outsourcing facilities, that independently evaluate, prepare, dispense, and ship any medication prescribed to you. Our Platform Disclosure describes the pharmacy network, and the pharmacy that dispenses your medication is identified on your medication label and in your order details.
Living Plus provides the technology, scheduling, communications, billing, and administrative support that make those relationships possible. Living Plus does not control, direct, or influence the clinical decisions of any provider or the dispensing decisions of any pharmacy.
Any provider-patient relationship you form exists solely between you and the treating provider practicing through OpenLoop Healthcare Partners, PC. Any pharmacy relationship exists solely between you and the dispensing pharmacy.
No compensation is tied to prescribing. Living Plus does not pay, and does not receive, any compensation that is conditioned on the issuance of a prescription, on the selection of any particular medication or formulation, or on the volume or value of prescriptions written. Providers are compensated for their clinical time and judgment, whether or not they prescribe.
Our support team cannot give medical advice. Living Plus support staff are not clinicians. They can help with your account, billing, shipping, and how to use the Platform, but they cannot answer medical questions, interpret symptoms, advise on dosing, or comment on whether a treatment is right for you. Direct all clinical questions to your provider through the Platform's secure messaging. Educational articles, general guidance, and automated messages on the Platform are informational only and are not medical advice.
Not for Emergencies
The Platform is not designed for urgent or emergency medical needs. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
If you are experiencing thoughts of self-harm or a mental health crisis, call or text 988 to reach the Suicide & Crisis Lifeline.
Do not rely on the Platform, messaging features, or provider response times in an emergency.
Eligibility and Where We Operate
To use the Platform, you must:
- Be at least 18 years of age;
- Be physically located, at the time of your visit, in a U.S. state or territory listed on our States Served page;
- Have the legal capacity to enter into a binding contract;
- Provide accurate, complete, and current information about yourself; and
- Use the Platform only for yourself, and not on behalf of another person.
Living+ services are available only in the states and territories identified on our States Served page, which lists every jurisdiction in which our provider network is licensed and notes where particular treatments or compounded preparations are not available. That page is the authoritative list and is dated so you can see when it was last reviewed.
Availability may differ by treatment and may change at any time. Some treatments offered on the Platform are not available in every state listed.
We may verify your identity, age, and physical location, and we may suspend or decline service if we are unable to do so. Providing a false location in order to obtain treatment is a material breach of these Terms and grounds for immediate termination.
No Guarantee of Treatment or Outcome
Submitting an intake form, paying a fee, or completing a consultation does not guarantee that a provider will prescribe any medication or recommend any particular course of treatment. Providers may determine that a requested therapy is not clinically appropriate for you, may recommend an alternative, or may decline to treat you entirely.
Individual results vary. No provider, and no statement made anywhere on the Platform, guarantees any specific weight loss, health outcome, or result. Statements from other patients reflect their individual experience only and are not a promise of results for you.
We do not publish, and you should not rely on, any representation about the likelihood that a given patient will be approved for treatment. Every assessment is evaluated individually on its clinical merits.
How Treatment Decisions Are Made
Treatment decisions on the Platform are made by a licensed provider, not by you and not by Living Plus.
- No prescription is issued before care is provided. A licensed provider reviews your health history and completes a clinical evaluation before any prescription is written. Completing an assessment or paying a fee does not create a prescription.
- Your provider selects the medication, the formulation, and the dose based on your medical history, your current medications, treatments you have tried before, and your clinical response. Living+ does not offer medications for selection or sale.
- Cost, convenience, and personal preference are not clinical criteria. They do not determine what is prescribed to you, and they are not a basis on which a compounded preparation is prescribed.
- Your provider may decline. A provider who declines to prescribe has exercised clinical judgment, and that decision is final as to that provider.
Synchronous visits where required. Some states require a real-time audio-video or telephone encounter before a prescription may be issued, or require an established provider-patient relationship. Where the law of your state requires it, your provider will schedule a live visit before prescribing, and asynchronous review alone will not be sufficient. You agree to participate in that visit if one is required.
Follow-up. Continued treatment, dose changes, and refills require ongoing provider review. Your provider may require lab work, additional information, or a follow-up visit before continuing therapy, and may discontinue treatment at any time on clinical grounds.
Compounded Medications — Important Disclosures
Certain medications prescribed through the Platform are compounded preparations produced by state-licensed 503A pharmacies or FDA-registered 503B outsourcing facilities.
- Compounded drugs are not FDA-approved. The FDA does not review compounded preparations for safety, efficacy, or manufacturing quality prior to distribution.
- Compounded medications may differ in formulation, concentration, inactive ingredients, and route of administration from any commercially available product, and they have not been studied in the clinical trials that supported approval of any commercially available product.
- A compounded preparation is prescribed only where a licensed provider determines, in independent clinical judgment and on the basis of your documented medical history, that a commercially available FDA-approved product is not suitable for you. That determination is recorded in your medical record.
- Lower cost, wider availability, and convenience are not clinical reasons to use a compounded medication, and are not accepted as such on this Platform.
- The dispensing pharmacy — not Living Plus — is responsible for sourcing, compounding, labeling, quality control, and dispensing.
Any reference on the Platform to a brand-name medication is for identification of the active ingredient only. A compounded preparation is not the brand-name product, is not equivalent to it, and is not endorsed by or affiliated with its manufacturer.
If you have questions about a compounded preparation, discuss them with your provider or the dispensing pharmacy before use.
Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to notify us promptly at support@livingplusrx.com if you suspect unauthorized access. You may not share, sell, or transfer your account. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.
Accuracy of Health Information
The care you receive depends entirely on the accuracy and completeness of the information you provide. You agree to disclose truthfully and completely your medical history, current medications and supplements, allergies, prior adverse reactions, pregnancy or breastfeeding status, and any other information requested during intake or follow-up.
Withholding or misrepresenting health information may result in serious harm to you. Providers may decline or discontinue treatment if they believe information you have supplied is inaccurate or incomplete.
You further agree to update your information promptly if it changes during treatment, and to report side effects and adverse reactions to your provider through the Platform without delay.
Telehealth Consent
Services on the Platform are delivered through telehealth, which may include asynchronous (store-and-forward) review, secure messaging, telephone, and video visits. Before your first consultation you will be asked to review and accept our Telehealth Consent, which describes the benefits, limitations, and risks of receiving care remotely, and which you may withdraw at any time.
Telehealth is not a substitute for in-person care in all circumstances, and your provider may advise you to seek in-person evaluation. Where your state's law requires a synchronous encounter before prescribing, one will be scheduled, as described in Section 6.
Memberships, Fees, and Automatic Renewal
What you pay. Your fees are displayed in full before you are charged. Your total is itemized into two components, and you will see both at checkout:
- Clinical care. Your evaluation, your provider's ongoing care, dose management, side-effect support, and secure messaging with your care team. If your provider decides not to prescribe, this amount is refunded to you in full, as described in Section 12.
- Medication. Charged only after a provider has issued a prescription. This amount is the same regardless of which medication or formulation your provider selects, so that no financial incentive influences the clinical decision.
You are never charged for medication before a licensed provider has reviewed your assessment and written a prescription. If your provider determines that treatment is not appropriate for you, everything you have paid — including the clinical care charge — is refunded in full.
Price changes and dose changes. Prices may change from time to time. A change will not affect the current paid term of an existing subscription, and we will notify you before a changed price applies to a renewal. Your price does not increase when your provider adjusts your dose within a course of treatment; if any dose or treatment change would alter what you pay, you will be told the new amount and asked to approve it before you are charged.
Authorization. By providing a payment method, you authorize us and our payment processors to charge that method for all applicable fees, taxes, and shipping charges. Amounts attributable to professional services are remitted to OpenLoop Healthcare Partners, PC; amounts attributable to medication are remitted to the dispensing pharmacy.
Subscription plans renew automatically at the end of each billing cycle at the then-current rate, and your payment method will be charged on the renewal date, until you cancel. We will send a reminder before each renewal of a plan with a term longer than one month, and before any renewal at a changed price.
You may cancel at any time, without contacting us and without giving a reason, directly from your account settings on livingplusrx.com. Cancellation takes effect at the end of the current billing period, and you retain access through that date. If you are unable to access your account, email support@livingplusrx.com or call +1 307-394-4014 and we will process the cancellation for you. Multi-month prepaid plans are billed in a single upfront charge for the full term.
Not insurance; no third-party reimbursement. Living Plus is not an insurance company and the Platform is not health insurance. All services are self-pay. We do not submit claims to, and do not accept payment from, commercial health plans, Medicare, Medicaid, TRICARE, the Veterans Health Administration, or any other federal or state healthcare program. If you are enrolled in Medicare, Medicaid, or another federal healthcare program, you agree that you are purchasing these services entirely outside that program and will not seek reimbursement for them from it. You are responsible for the full cost of services.
Failed payments. If a charge fails, we may suspend Platform access and pause fulfillment until payment is resolved.
Refunds and Cancellation
This section is our complete refund and cancellation policy. It applies to all fees paid through the Platform.
How to cancel
You may cancel at any time, for any reason, without contacting anyone, from your account settings on livingplusrx.com. You may also cancel by emailing support@livingplusrx.com or calling +1 307-394-4014. To avoid a further charge, cancel before your renewal date. Cancelling stops future billing; it does not by itself refund amounts already charged, which are governed by the table below.

Nothing in this section limits any refund right you have under the mandatory consumer protection law of the state in which you reside.
Before you dispute a charge
If something looks wrong on your statement, contact us first at support@livingplusrx.com — most billing issues are resolved within one business day. We reserve the right to respond to a chargeback with documentation of your authorization and the services provided.
Changes to this policy
Changes apply to future billing cycles only and never retroactively to a charge already made.
Prescriptions, Fulfillment, and Shipping
If a provider issues a prescription, it will be transmitted to a licensed pharmacy selected by the provider. Every pharmacy in the network is licensed in the state to which it dispenses; our Platform Disclosure describes the network, and the pharmacy that dispenses your medication is identified on your medication label and in your order details.
You are not obligated to use a partner pharmacy. You may request that your prescription be sent to a pharmacy of your choosing, or transferred to one, subject to applicable law and pharmacy policy. Ask your provider or our support team and we will arrange it. If you fill your prescription elsewhere, you pay that pharmacy directly and your Living+ medication charge does not apply.
Title and risk of loss for shipped medication pass to you upon delivery to the carrier. Delivery timelines are estimates only. Neither Living Plus nor the pharmacy is responsible for carrier delays, misdelivery caused by an incorrect address you supplied, or damage resulting from your failure to retrieve or store a temperature-sensitive package promptly. Some shipments require adult signature.
Refills and dose changes require provider review and are not automatic. Federal and state law prohibit the return, resale, or transfer of dispensed prescription medication to any other person.
Communications Consent
By providing your contact information, you consent to receive communications from Living Plus, your provider, and the dispensing pharmacy by email, telephone, and SMS/text message, including messages sent by automated systems, relating to your account, your care, shipments, and billing. Message and data rates may apply. You may opt out of marketing messages at any time by following the unsubscribe instructions or replying STOP; you may not opt out of transactional and care-related messages while you remain an active patient.
Standard email and SMS are not fully secure and are not encrypted end-to-end. We limit these channels to account, billing, shipping, and scheduling messages, and we do not send detailed clinical information over them. Clinical communication with your provider takes place through the Platform's secure messaging. If you choose to send us health information by email or text, you accept the risk that it could be intercepted or viewed by others.
Acceptable Use
You agree not to:
- Provide false, misleading, or another person's information, including a false statement of the state you are physically located in;
- Attempt to obtain medication for anyone other than yourself, or for resale, diversion, or non-medical purposes;
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Platform or its underlying systems;
- Scrape, crawl, reverse engineer, or use automated means to access the Platform;
- Use the Platform in violation of any applicable federal, state, or local law; or
- Harass, threaten, or abuse our staff, providers, or pharmacy personnel.
We may suspend or terminate access immediately for any violation of this section.
Intellectual Property
The Platform and its contents — including the Living Plus and Living Plus Rx names, logos, wordmarks, text, graphics, interface design, and software — are owned by Living Plus Rx LLC or its licensors and are protected by U.S. and international intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Platform for your personal, non-commercial use. All rights not expressly granted are reserved.
You may not copy, reproduce, republish, or create derivative works from Platform content without our prior written permission.
Any third-party trademarks referenced on the Platform, including brand names of FDA-approved medications, are the property of their respective owners. Their use is nominative and for identification only, and does not indicate any affiliation with, sponsorship by, or endorsement from those owners.
Your Content
If you submit photographs, messages, reviews, or other content, you grant Living Plus a non-exclusive, worldwide, royalty-free license to use that content solely as necessary to operate the Platform and provide services to you. We will not use your name, image, photographs, or testimonial in marketing without your separate, specific, written authorization, which you may revoke at any time. Clinical information you submit is handled as protected health information in accordance with our Privacy Policy, our Notice of Privacy Practices, and applicable law. Do not submit content you do not have the right to share.
Privacy
Our collection and use of your information is described in our Privacy Policy and our Notice of Privacy Practices. Protected health information created in connection with your care is maintained by OpenLoop Healthcare Partners, PC, with Living Plus acting as a business associate under a written business associate agreement as required by HIPAA.
We do not sell your personal information or your health information, and we do not share your health information with advertising platforms or use it to target advertising to you. All transmission of your information through the Platform is encrypted in transit.
Third-Party Services and Links
The Platform may reference or link to third-party websites, products, or services, including payment processors, laboratories, shipping carriers, and pharmacies. We do not control and are not responsible for third-party content, practices, or policies. Your dealings with third parties are solely between you and them.
Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.
LIVING PLUS MAKES NO WARRANTY REGARDING ANY MEDICAL SERVICE, CLINICAL JUDGMENT, DIAGNOSIS, PRESCRIPTION, OR MEDICATION PROVIDED BY ANY INDEPENDENT PROVIDER OR PHARMACY.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the fullest extent permitted by law.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVING PLUS AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO LIVING PLUS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for gross negligence, willful misconduct, fraud, or personal injury or death caused by our negligence. These limitations do not apply to claims of professional negligence against a treating provider or a dispensing pharmacy, which are governed by applicable state law and are not waived, capped, or released by these Terms.
Indemnification
You agree to indemnify, defend, and hold harmless Living Plus and its members, managers, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your breach of these Terms; (c) inaccurate or incomplete information you provided; (d) your misuse, diversion, or transfer of any medication; or (e) your violation of any law or of the rights of any third party.
This section does not require you to indemnify us against our own negligence or misconduct, or against any claim arising from the professional negligence of a provider or pharmacy.
Dispute Resolution; Binding Arbitration; Class Action Waiver
This section affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Informal resolution first. Before initiating arbitration, you agree to contact us at support@livingplusrx.com with a written description of the dispute and to attempt in good faith to resolve it for at least sixty (60) days.
Agreement to arbitrate. Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules. Arbitration will be conducted in Cheyenne, Wyoming, or by videoconference or on the documents at your election where the rules permit. The arbitrator has exclusive authority to resolve disputes about the interpretation, applicability, and enforceability of this section.
Class action waiver. YOU AND LIVING PLUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY REPRESENTATIVE PROCEEDING.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or confidential information. This section does not apply to any claim of professional negligence or medical malpractice against a treating provider or dispensing pharmacy, and does not limit your right to file a complaint with any state licensing board, regulatory agency, or attorney general.
You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing support@livingplusrx.com with the subject line "Arbitration Opt-Out," stating your name, the email address on your account, and your intent to opt out. You may instead send the same notice by mail to Living Plus Rx LLC, 1501 South Greeley Hwy, Ste C #1542, Cheyenne, WY 82007. Opting out will not affect your ability to use the Platform or any other part of these Terms.
Severability. If the class action waiver is found unenforceable as to any claim, that claim will proceed in court and all other claims will remain in arbitration.
Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Laramie County, Wyoming. The Federal Arbitration Act governs the interpretation and enforcement of Section 23.
Nothing in this section deprives you of the protection of any mandatory consumer protection law of the state in which you reside that cannot be waived by agreement, and nothing in these Terms displaces the law of the state in which you are located as it governs the practice of medicine, the practice of pharmacy, telehealth, or professional licensure.
Termination
You may stop using the Platform and cancel your subscription at any time as described in Section 12. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, if continued service presents a legal or clinical risk, or if we discontinue the Platform.
If we terminate the Platform or your access to it, your provider remains responsible for the continuity of your care consistent with professional obligations, and you may request a copy of your medical record from OpenLoop Healthcare Partners, PC at any time.
Sections 7, 16, 17, and 20 through 28 survive termination. Termination does not entitle you to a refund of amounts already paid except as provided in Section 12 or required by law.
Concerns, Complaints, and License Verification
If you have a concern about your care, your medication, or how the Platform operates, contact us at support@livingplusrx.com or +1 307-394-4014. We will acknowledge your concern and, where it is clinical, route it to the Practice for review.
- Verify your provider's license. You may confirm your provider's name, license number, and standing with the medical or nursing board of your state at any time. Ask us or your provider and we will supply the details you need to look them up.
- File a complaint with a regulator. You may file a complaint with your state medical or nursing board, your state board of pharmacy, your state attorney general, or the U.S. Food and Drug Administration, at any time and without contacting us first.
- Report a privacy concern. Privacy complaints may be directed to the Practice's Privacy Officer or to the U.S. Department of Health and Human Services, Office for Civil Rights, as described in our Notice of Privacy Practices.
- Report a side effect. Adverse reactions should be reported to your provider immediately, and may also be reported to the FDA MedWatch program.
We will not retaliate against you in any way for raising a concern or filing a complaint.
General Provisions
Changes. We may modify these Terms at any time. Material changes will be posted with an updated "Last updated" date and, where required, communicated to you directly at least thirty (30) days before they take effect. Continued use after changes take effect constitutes acceptance.
Entire agreement. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Living Plus regarding the Platform and supersede all prior understandings.
Severability. If any provision is held unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including supply chain disruption, pharmacy or manufacturer shortages, regulatory action, natural disaster, or carrier failure.
Electronic communications. You consent to receive communications, agreements, disclosures, and notices from us electronically, and you agree that electronic acceptance satisfies any legal requirement that such communications be in writing.
