What “Consumer Health Data” Means
This policy explains how Living Plus Rx LLC (“Living Plus,” “we,” “us”) collects, uses and shares consumer health data. It applies to residents of Washington under the My Health My Data Act, residents of Nevada under Senate Bill 370, residents of Connecticut under the Connecticut Data Privacy Act, and anyone else whose consumer health data we handle. It adds to our Privacy Policy; where the two differ on consumer health data, this policy controls.
Consumer health data is personal information that is linked or reasonably linkable to you and identifies your past, present or future physical or mental health. That includes information we infer, for example that you may be interested in weight-loss care because you signed up on a weight-loss page.
Health information you give a licensed provider as part of your care is protected health information under HIPAA. It is held by your treating provider and covered by their Notice of Privacy Practices, not by this policy.
Consumer Health Data We Collect
- Sign-up details: your name, email, mobile number (optional) and state, together with the fact that you signed up for weight-loss care or another treatment program.
- Treatment interest: the treatment or program pages you visited, the links you clicked to start an assessment, and any treatment preference you tell us.
- Messages you send us: anything you write in our website chat, by email, text message or phone, which may include health details you choose to share.
- Consent records: what you agreed to, the exact wording you saw, and when, from which device and IP address.
- Website activity: pages viewed on livingplusrx.com, how you arrived (for example a campaign link), and device type. For website activity we store a scrambled (hashed) version of your IP address, not the address itself.
Where We Get It
- Directly from you, when you fill in a form, chat with us, email, text or call.
- Automatically from your browser, when you use our website.
- From our clinical platform partner, limited to whether you started or completed an assessment, so we can follow up on care you asked for.
Why We Collect and Use It
- To provide what you asked for: to answer your questions, help you start an assessment with a licensed provider, and contact you about your request.
- To send you marketing emails or texts, only if you opted in to that channel. You can withdraw at any time.
- To keep records of your consent and your choices, and to honor unsubscribe and opt-out requests.
- To understand which pages and campaigns help people find care, and to improve our website.
- To keep our services secure, prevent fraud and spam, and meet our legal obligations.
We collect only what is needed for these purposes. We do not use consumer health data for any other purpose without asking you first.
Consumer Health Data We Share
We share the categories of data in Section 2, only as needed for the purposes in Section 4:
- Your contact details and the fact that you asked about a treatment, with our clinical platform partner, so you can start an assessment you requested.
- Contact details, treatment interest, messages and consent records, with service providers that run our systems for us under contract and may use the data only to provide services to us.
Who We Share It With
Third parties. Our clinical platform partner, OpenLoop, and the independent licensed providers and pharmacies in its network, when you choose to start an assessment.
Service providers, by category.
- Customer relationship, chat, email and text messaging platform (HighLevel / LeadConnector).
- Email delivery (Amazon Web Services).
- Website and server hosting, and content delivery (SiteGround, Hostinger, Bunny.net).
- Business email and documents (Google Workspace).
Affiliates. We do not share consumer health data with any affiliate.

Your Rights
Depending on where you live, you have the right to:
- Confirm and access: ask whether we collect, share or sell your consumer health data, get a copy of it, and get a list of every third party and affiliate we have shared it with, with their contact details.
- Withdraw consent: withdraw any consent you gave for us to collect or share your consumer health data. Withdrawing does not affect what we did before.
- Delete: ask us to delete your consumer health data. We will also tell our service providers and any third party we shared it with to delete it. Information in your medical record held by your provider may have to be kept by law.
- Correct: ask us to fix information that is wrong.
- Appeal: appeal if we turn down your request.
We will not treat you differently for using these rights.
